The Build America, Buy America Act establishes domestic-sourcing requirements for covered iron, steel, manufactured products, and construction materials used in federally funded infrastructure projects. For natural gas utilities, that can turn “Made in the USA” from a preference into a project requirement.
PHMSA’s Natural Gas Distribution Infrastructure Safety and Modernization program was authorized at $200 million per year - $1 billion over five years—to help municipal and community-owned gas systems repair, replace, and modernize distribution infrastructure.

What documentation should I request?
Start with a manufacturer’s certificate identifying the product and the basis for its domestic-content claim. Your funding agency or contract may require additional records, so the project documents remain the controlling source.
How do I know whether BABA applies to my project?
BABA generally applies when federal financial assistance supports construction, alteration, maintenance, or repair of infrastructure in the United States. Confirm the award terms, funding agency guidance, and contract requirements for the project.
What is the difference between BABA and AIS?
BABA is a government-wide domestic-sourcing framework for federally assisted infrastructure. American Iron and Steel requirements are separate domestic-preference provisions that apply to certain programs and iron or steel products. A manufacturer’s documentation should identify the requirements it supports.
Are waivers available?
Some agencies and programs issue product-specific, project-specific, public-interest, small-project, or other waivers. Never assume a waiver applies; confirm it against the funding program and project terms. Additionally, some waivers have taken years to gain approval.
